Newsletter registration

If you register for our newsletter on our website, the data entered will be stored by MailChimp. The newsletter is sent using the US provider "MailChimp", which also stores the email addresses and other information for sending and analyzing the newsletter. Mailchimp is Privacy Shield certified. The registration procedure is the so-called double opt-in. You will be asked to confirm the registration. You can object to receiving the newsletter at any time (so-called opt-out). Amazon CloudFront

We use the Amazon CloudFront content delivery network (CDN) from Amazon Web Services EMEA SARL, 38 avenue John F. Kennedy, L-1855 Luxembourg (AWS) to increase the security and delivery speed of our website. This corresponds to our legitimate interest (Art. 6 para. 1 lit. f GDPR). A CDN is a network of [globally] distributed servers that is able to deliver optimised content to the website user. For this purpose, personal data may be processed in server log files by AWS. Conditions of participations for raffle conditions

1. Subject 
These conditions of participation and data protection information govern the participation in the "Hypomeeting Götzis / Vorarlberg" raffles, carried out and organized by the Verein zur Förderung der Leichtathletik ("Organizer"), Knie 6, 6850 Dornbirn, Austria by the participants as well as the collection and use of the data collected or communicated by the participants. By participating in the competition, participants accept these conditions of participation. 

2. Conditions of participation 
The competition begins on 10.05.2023 and ends on 16.05.2023. Eligible to participate are persons (Instagram and Facebook users) who are older than 16 years. Excluded are employees of the organizer and employees of cooperation partners who are or were involved in the creation or execution of the competition. The legal process is excluded. The participating person may only enter once per competition. Automated entries are excluded from participation. Participation in the competition is free of charge and there is no obligation to buy anything. Prizes will be raffled off that are provided free of charge by Vorarlberg companies. The entry is made by commenting under the original posting on the Instagram or Facebook page of Hypomeeting Götzis / Vorarlberg. Comments under shared posts on other pages are excluded from participation. The winners will be determined randomly by Hypomeeting Götzis / Vorarlberg. The prizes will be drawn at the end of the participation period.

3. Rights of use, exemption and responsibility 
The Hypomeeting Götzis / Vorarlberg is not obliged to check the postings provided by the participants for potential infringements of the rights of third parties. However, the Hypomeeting Götzis / Vorarlberg is entitled to reject such postings if, in its reasonable opinion, they are unlawful or contrary to public policy. By uploading content, in particular images, participants declare that the content is free of third-party rights, i.e. that it either originates from them or that they have obtained the consent of the persons holding the copyright and of the persons depicted in images and videos. The participants* indemnify Hypomeeting Götzis / Vorarlberg from all claims of third parties that have arisen due to the postings provided to the participating persons. They agree to support Hypomeeting Götzis / Vorarlberg in every reasonable way in defending these claims. The participants agree that their submissions (postings) in connection with the competition, the draw, processing and presentation of the participants' entries may be used by Hypomeeting Götzis / Vorarlberg in online and offline media (e.g. in print), disseminated and otherwise made publicly available to third parties. For these purposes, Hypomeeting Götzis / Vorarlberg is also permitted to edit the submissions and, if necessary, to grant third parties rights of use to them. This granting of rights is free of charge and without any restriction in terms of space, content or time. 

4. Settlement 
Payment of the prize in cash, in kind, its exchange or transfer to other persons is not possible. A participating person can renounce the prize. In this case, the next participating person in the order of winners will take his/her place or a new person will be determined. The handover of the winnings will be coordinated individually with the participating persons. The Hypomeeting Götzis / Vorarlberg will contact the drawn winners. They will be asked for their full name, e-mail address and telephone number. If the contacted person does not respond to our letter by 25.05.2023 after sending the notification, the claim to the prize will expire and a new person will be drawn for the prize. If the address given is incorrect, Hypomeeting Götzis / Vorarlberg is not obliged to find out the correct contact details. Any disadvantages resulting from the provision of incorrect contact details will be borne by the participants.

5. Disclaimer of warranty;
Hypomeeting Götzis / Vorarlberg points out that the availability and function of the competition cannot be guaranteed. The competition can be terminated or removed due to external circumstances and constraints, without this resulting in claims of the participants against Hypomeeting Götzis / Vorarlberg. This may include technical problems, rule changes or decisions by platforms such as Instagram and/or Facebook, if the sweepstakes is organized on or in connection with them.

6 Liability
For a liability of Hypomeeting Götzis / Vorarlberg for damages, the following exclusions and limitations of liability apply, without prejudice to the other legal requirements for claims under this clause 6. The Hypomeeting Götzis / Vorarlberg is liable without limitation as far as the cause of damage is based on intent or gross negligence. Furthermore, Hypomeeting Götzis / Vorarlberg is liable for the slightly negligent violation of essential obligations, the violation of which endangers the achievement of the purpose of the contract, or for the violation of obligations, the fulfillment of which enable the proper execution of the competition in the first place and on the compliance with which the contracting parties regularly rely. In this case, however, Hypomeeting Götzis / Vorarlberg shall only be liable for the foreseeable, contract-typical damage. Hypomeeting Götzis / Vorarlberg shall not be liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences. The above limitations of liability do not apply in case of injury to life, body and health, for a defect after acceptance of guarantees for the quality of a product and in case of fraudulently concealed defects. The liability according to the product liability law remains unaffected. As far as the liability of Hypomeeting Götzis / Vorarlberg is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of the organizer.

7. Data protection information
The Hypomeeting Götzis / Vorarlberg collects and uses the data of the participating persons only insofar as this is necessary for the implementation of the competition or the participants consent to it. The following data will be collected from the participants by Hypomeeting Götzis / Vorarlberg and will be used for the design, implementation and execution of the sweepstakes: name of the participating person, email address, Instagram or Facebook user ID and profile picture.

8. Notices and conditions of Facebook/Instagram
In addition to these conditions of participation, the relationship between Hypomeeting Götzis / Vorarlberg, the participating person and Facebook/Instagram is determined by the conditions of participation https://www.facebook.com/terms.php and the privacy policy of Facebook/Instagram: https://www.facebook.com/privacy. Participants may not assert any claims against Facebook/Instagram arising in connection with the use of the sweepstakes application or participation in the sweepstakes. Participants acknowledge that both the Sweepstakes Application and the Sweepstakes are in no way sponsored, endorsed, organized, or affiliated with Facebook/Instagram. All information and data communicated through the use of the sweepstakes application or during the sweepstakes by participants or collected by them will only be provided to Hypomeeting Götzis / Vorarlberg and not to Facebook. All inquiries and notices regarding the sweepstakes are to be directed to Hypomeeting Götzis / Vorarlberg and not to Facebook/Instagram.
